Copyright Basics

Copyright protects original creative works — writing, art, music, code, photography — from the moment of creation. You do not need to register or add a notice. Copyright gives creators exclusive rights to reproduce, distribute, adapt, and publicly display their work.

Fair Use: The Four Factors

  1. Purpose and character: Is the use transformative? Educational? Commercial?
  2. Nature of the work: Is the original factual or creative? (Factual works get less protection)
  3. Amount used: How much of the original was used? Was the "heart" of the work taken?
  4. Market effect: Does the use harm the market for the original?
Transformative Use:Using copyrighted material in a way that adds new meaning, expression, or message — a key factor in fair use analysis.
Fair Use Is Not a Loophole

Fair use is a legal defense, not a guaranteed right. Courts weigh all four factors together. When in doubt, seek permission or use openly licensed alternatives.
